Agreement to Terms

By accessing or using the Off The Couch website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services.

Nature of Services

Coaching Services

Off The Couch provides sober coaching, life coaching, case management, and adventure-based mentorship services for teens and young adults. Our services are designed to support personal growth, recovery, and life skill development.

Scope of Practice

Our coaching services focus on goal-setting, accountability, skill-building, and personal development. We work collaboratively with clients and families to create actionable plans for positive change. Our services complement—but do not replace—professional medical, psychiatric, or therapeutic treatment.

Client Responsibilities

By engaging our services, you agree to:

• Provide accurate and complete information about your situation and needs
• Actively participate in coaching sessions and complete agreed-upon action steps
• Communicate openly and honestly with your coach
• Notify us immediately of any changes in mental health status, substance use, or safety concerns
• Maintain appropriate professional boundaries with coaches and staff
• Make timely payments for services as agreed
• Provide at least 24 hours' notice for session cancellations or rescheduling

Payment and Cancellation Policy

Payment Terms

Payment for coaching services is due at the time of service unless alternative arrangements have been made in advance. We accept various payment methods including credit cards, debit cards, and electronic transfers. Specific pricing and payment schedules will be outlined in your coaching agreement.

Cancellation Policy

We require at least 24 hours' notice for session cancellations or rescheduling. Cancellations made with less than 24 hours' notice, or missed sessions without notification, may be subject to a cancellation fee. We understand that emergencies happen and will work with you on a case-by-case basis.

Refund Policy

Refunds for services are handled on a case-by-case basis. If you are unsatisfied with our services, please contact us to discuss your concerns. We are committed to finding a fair resolution.

Confidentiality

We respect your privacy and maintain confidentiality of information shared during coaching sessions, subject to the following exceptions:

• Imminent Danger: If we believe there is an imminent risk of harm to you, your child, or others, we may disclose information to appropriate authorities or individuals
• Child Abuse or Neglect: We are mandated reporters and must report suspected child abuse or neglect to appropriate authorities
• Legal Requirements: We may disclose information if required by law or court order
• With Your Consent: We may share information with other professionals involved in your care (e.g., therapists, doctors) with your explicit written consent

For clients under 18, parents/guardians have the right to access information about coaching sessions, progress, and concerns. We encourage open communication between coaches, clients, and families.

Parent Portal Terms

If you have been granted access to our Parent Portal, you agree to:

• Keep your login credentials secure and confidential
• Not share your account access with unauthorized individuals
• Use the portal only for its intended purpose (viewing updates and communicating with coaches)
• Notify us immediately if you suspect unauthorized access to your account
• Respect the privacy and confidentiality of information shared through the portal

Limitation of Liability

To the fullest extent permitted by law, Off The Couch and its coaches, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any conduct or content of any third party related to our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

Our coaching services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee specific outcomes or results from our coaching services.

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Off The Couch and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our express written permission.

Termination

Either party may terminate the coaching relationship at any time for any reason. We reserve the right to refuse service or terminate our relationship with any client who:

• Violates these Terms of Service
• Engages in threatening, abusive, or inappropriate behavior toward coaches or staff
• Fails to make timely payments as agreed
• Provides false or misleading information
• Is not making progress or engaging meaningfully in the coaching process

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the courts of Los Angeles County, California.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new Terms of Service on this page and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the new terms.
